PURCHASE AGREEMENT
PREAMBLE
Thank you for using the Beat TV online ticketing service. Your purchase of Beat TV tickets through the Service is subject to the terms of the present Purchase Agreement for tickets Service Agreement and the Privacy Policy. When reference is made to the "Agreement" it shall also include the Terms of Use and the Privacy Policy, which are incorporated by reference herein as if recited at length. If there should be inconsistencies between the present Purchase Agreement and the Terms of Use or Privacy Policy, the Purchase Agreement shall prevail.
By purchasing tickets through the Service, you agree to be bound by the Agreement.

This preamble shall form an integral part of the Agreement.
PARTIES
The parties to the Agreement (the Parties) are:

(hereinafter referred to as Beat TV)

You (also referred to as the "Customer", and may be written as You or you)
PURCHASED TICKETS
You hereby agree to purchase and Beat TV agrees to sell the ticket(s) detailed in your Order Confirmation (as defined below). The purchase of the Ticket(s) grants the bearer the revocable license to view the event described on the Ticket(s). No other relationship between the Parties, either expressed or implied, is created by your purchase of the Ticket(s).
ORDER CONFIRMATION
Once your order is confirmed and your payment completed, you will receive a confirmation page and/or email indicating a confirmation number (the Order Confirmation). You must keep your confirmation number.
If, for any reason whatsoever, you do not receive a confirmation number or if you receive an error message or encounter a service interruption, it is your entire responsibility to contact our Customer Service Department [613-898-2638] to confirm whether your order has been properly processed. You are solely responsible for any problem that may occur during the purchase of Ticket(s). In such case, Beat TV shall not be responsible for any loss (monetary or otherwise) that may result from any problem occurring during the purchase of Ticket(s) through this website, including, without limitation, the failure of a transaction to be completed or confirmed, whether through the actions of Beat TV and /or its related entities, or a third party.
Orders will be processed only after payment has been processed. Occasionally, we receive incorrect billing or credit card account information for a ticket order. This can delay the processing of the order and the delivery of the Ticket(s). In such case, Beat TV' Customer Service Department may attempt to contact you, using the information provided at the time of purchase. If Beat TV is unable to reach you after an initial attempt, it shall reserve the right to cancel your order and sell your Ticket(s) to another customer.
OBLIGATION TO PAY
By accepting the terms of this Agreement, you agree to pay the full price of the Ticket(s) ordered, including any applicable taxes and delivery, convenience and other fees, as described on the Order Confirmation page or e-mail. Ticket(s) prices for events that occur in Canada are stated in Canadian Dollars.
REFUNDS AND EXCHANGES
You must review your Ticket selection before you submit and confirm your order. Subject to the provisions below for cancelled and/or postponed events, there are no exchanges or refunds once the Ticket(s) have been purchased.
DELIVERY
The Ticket(s) will be delivered via the e-mail address of your account. Note that certain fees are applicable on the sale of a ticket.
CANCELLED AND/OR POSTPONED EVENTS
When an event is cancelled or postponed, Beat TV may, at its sole and exclusive discretion, either offer you an exchange or a refund. You have the sole responsibility of verifying if an event for which you have purchased tickets through this website is cancelled or postponed. If an event is cancelled or postponed, Beat TV will inform you through via email about procedures for making an exchange or obtaining a refund.
If an event is cancelled, as a general rule the credit card with which you purchased the Ticket(s) will be refunded. However, Beat TV reserves the right to decide on an alternative refund or exchange method for a particular event.
Beat TV may change its refund and/or exchange policies at any time, at its sole and exclusive discretion. Any change to the policy may be found at the present URL.
LATE ARRIVAL
The event starts on time and latecomers may connect to the event at any time during the event.
RIGHT TO CANCEL TICKETS, REFUSE ACCESS AND EXPEL
Beat TV reserves the right to cancel any Ticket(s) or order of Ticket(s) through this website and to institute legal proceedings against you if you breach any provision of the Agreement or this website.
Beat TV reserves the right to request photo ID of the Ticket(s) holder.
In the event any person attending an event is judged unmanageable or exhibits behavior which is considered inappropriate, or fails to comply with Beat TV rules, Beat TV reserves the right, without any refund or compensation, to terminate such person's license to attend the event and immediately expel such person.
The Ticket(s) purchased on this website are revocable licenses and admission to a Ticket holder may be refused for any reason (or no reason) at the sole discretion of Beat TV, its employees, agents, officers or representatives, upon refunding the Ticket's face value. Ticket(s) shall not be redeemable for cash.
RECORDING, TRANSMISSION AND PUBLICATION
All cameras, tape recorders and video recorders (including when incorporated in cellular phones or other mobile devices) and their use are strictly forbidden on the site of the event.
You hereby grant Beat TV the right to use your image, likeness, actions and statements in any transmission, publication or reproduction of the event in any means or circumstances, without any further permission or compensation.
NO RESALE
Any unlawful resale of Ticket(s) is strictly prohibited. Beat TV reserves the right to cancel the license granted under the Ticket(s) and in connection with any fraudulent sale of such Ticket(s), without refund or other compensation.
NO PROMOTION WITHOUT PERMISSION
The Ticket(s) and may not be used for any advertising and/or promotional purposes (including contests and sweepstakes) or resold for the purposes of same without the prior written authorization of Beat TV.
USE OF PERSONAL INFORMATION
In addition to and without limiting the generality of the provisions set out in our Privacy Policy, by purchasing Ticket(s) through this website, you expressly agree that the personal information you provide us may be used by Beat TV or its affiliates and other persons acting on behalf of Beat TV, in order to deliver the Ticket(s) to you and add you to our distribution list to propose you offers and other promotional or marketing activities and to provide you with the latest information about Beat TV. We remind you that if you wish that we discontinue use of your personal information, please contact us via email at: support@beattv.ca.
LIMITATION OF LIABILITY
Notwithstanding all security measures in place on the site, injury may occur during an event. By accepting the terms of the Agreement, you assume all risk, liability and responsibility for any and all damages of any nature suffered by you, including, without limitation, bodily harm and loss of property incurred during or in connection with the event. Furthermore, you hereby waive any and all rights to claim damages, monetary or otherwise, or to institute civil, criminal, administrative or legal proceedings against Beat TV, its affiliates and other related entities or their directors, officers, administrators, employees, representatives and all other persons acting on behalf of Beat TV, resulting from any cause whatsoever arising either before, during or after the event.
In certain cases, applicable laws may not allow the limitation of liability set forth above, so this limitation of liability may not apply in such particular cases. If any part of this limitation on liability is found to be invalid or unenforceable for any reason, then Beat TV aggregate liability (and that of its affiliates and other related entities or their directors, officers, administrators, employees, representatives and all other persons acting on behalf of Beat TV) under such circumstances for liabilities that otherwise would have been limited shall not exceed one hundred Canadian dollars (CAN$100).
INDEMNIFICATION
You hereby agree to indemnify and hold harmless Beat TV, its affiliates and other related entities, their directors, officers, administrators, managers, employees, representatives and all other persons acting on behalf of Beat TV from and against any and all claims, actions, damages or other demands, including, but not limited to, reasonable costs and expenses of litigation such as counsel fees, arising from or relating to your purchase of Ticket(s).
APPLICABLE LAWS AND EXCLUSIVE JURISDICTION
The parties hereby agree that this Agreement shall be governed by and interpreted according to the laws applicable within the Province of Ontario in force at the time, without regard to conflict of law provisions. Furthermore, the parties hereby elect to submit to the exclusive jurisdiction of the Courts of the Province of Ontario, in the Judicial District of Ottawa, in respect of any action or proceeding arising out of or related to the Agreement.
TICKET CONDITIONS
The following paragraph appears on all printed Tickets and forms an integral part of the Agreement:
IMPORTANT No exchange and no refund. Upon cancellation of an event for which no other date has been selected, this ticket may be refunded pursuant to the conditions set forth by the promoter of the event and BEAT TV. No refund of service fees. Any falsification or resale of tickets is prohibited. This ticket is void following a sworn complaint of theft thereof to the local police station. This ticket grants the right to its holder to view the event and grants no other right. This ticket may not be used for advertising, promotion (including contests and sweepstakes) or other commercial purposes without the prior written consent of the (Beat TV) or from the artist, as the case may be. The holder of this ticket assumes any and all liabilities as to the risks and dangers that may result from this event and renounces to any claim for loss or damage whatever the cause, incurred or suffered by the holder, whether occurring before, during or after the event. The holder of this ticket renounces to any claim resulting from the capture or transmission of his image during the broadcast. The use of this ticket is subject to the rules in force on the platform where the event takes place. You must comply with the rules established by the promoter of the event. Management reserves the right to refuse access to the event or to evict any person whose behavior shall be deemed inadequate with or without refund of the price of the ticket. The holder of the ticket may be frisked at the entrance of certain events. The use of cameras, tape recorders and camcorders is also prohibited. This ticket or the rights represented hereby or arising herefrom may not be assigned, sold or transferred commercially or as part of a promotion, with or without consideration, without the express written consent of the issuer and the producer.
GENERAL
Where a Court of Competent Jurisdiction declares a portion of the Agreement invalid or unenforceable, the remainder of the Agreement shall remain in force.
The headings in the Agreement are provided for clarity only and do not form an integral part of the Agreement.
Where you have read the Agreement in English, the Parties agree that the Agreement shall be drawn up in the English language. You can also request the Agreement in French.
CONTRAT D'ACHAT
PRÉAMBULE
Merci d'avoir utilisé le service d'achat de billets en ligne (le « Service ») de Beat TV. Votre achat de billets des de Beat TV par le biais du Service est sujet au présent Contrat d'Achat de billets (le « Contrat ») les Services d’entente et la Politique de confidentialité.
Lorsque référence est faite au présent « Contrat », elle inclut également les Termes et conditions et la Politique de confidentialité en références ci-incluses. Dans l'éventualité de quelque différence que ce soit entre le présent Contrat d'Achat, les Termes et Conditions et la Politique de confidentialité, le Contrat d'Achat aura préséance.
En faisant l'achat de billets par le Service vous acceptez d'être lié par le Contrat.

BILLETS ACHETÉS
Par les présentes, vous acceptez d'acheter et Beat TV accepte de vendre le(s) billet(s) détaillé(s) dans votre bon de commande (décrit ci-dessous). L'achat de billet(s) donne au porteur une licence révocable pour assister à l'événement tel que décrit sur le(s) billet(s). Aucune autre forme d'obligation entre les Parties, qu'elle soit exprimée ou implicite, ne provient de l'achat de(s) billet(s).
CONFIRMATION DE COMMANDE
Lorsque votre commande a été confirmée et que votre paiement a été complété, vous recevrez une page de confirmation et/ou un courriel indiquant un numéro de confirmation (la « Confirmation de commande »). Vous devez conserver votre numéro de confirmation.
Si, pour quelque raison que ce soit, vous ne recevez pas de numéro de confirmation ou si vous recevez un message d'erreur ou s'il y a interruption de service, il est de votre entière responsabilité de communiquer avec notre Service à la clientèle {C}afin de confirmer si votre commande a dûment été traitée. Vous êtes entièrement responsable de tout problème qui pourrait survenir durant le processus d'achat de billets. Dans un tel cas, Beat TV ne sera pas responsable de toute perte (monétaire ou autre) qui pourrait résulter de tout problème pouvant survenir lors de l'achat de billet(s) via ce site Web, incluant sans s'y restreindre, le fait qu'une transaction n'a pas été complétée ou confirmée que ce soit par Beat TV et/ou ses entités ou une tierce partie.
Les commandes seront traitées seulement après la confirmation du paiement. Nous recevons occasionnellement des renseignements erronés relativement à la facturation ou aux informations du compte de crédit lors de la commande de billets. Ces erreurs ou informations inexactes peuvent retarder le traitement de la commande et la livraison de(s) billet(s). Advenant un tel cas, le Service à la clientèle de Beat TV peut tenter de communiquer avec vous en utilisant l'information obtenue au moment de l'achat. Si Beat TV est dans l'impossibilité de vous rejoindre après une première tentative, nous nous réservons le droit d'annuler toute commande et de vendre votre/vos billet(s) à un autre client.
OBLIGATION DE PAIEMENT
En acceptant les termes du présent Contrat, vous acceptez de payer en entier le prix du/des billet(s) commandé(s), incluant toutes taxes et tous frais de livraison, de service et autres coûts applicables tel que décrit sur la page de Confirmation de commande ou le courriel. Les prix de billets pour les événements présentés au Canada sont exprimés en devise canadienne.
REMBOURSEMENTS ET ÉCHANGES
Vous devez réviser votre sélection de billets avant de soumettre et confirmer votre commande. Sujet aux dispositions ci-après stipulées pour les événements annulés et/ou reportés, il n'y a aucun échange ni remboursement une fois qu'un billet a été acheté.
LIVRAISON
Ces billets vous sont livrés par courriel à l'adresse électronique que vous indiquez a la création de votre compte. Notez que certains frais sont applicables lors de l’achat de votre billet.
ÉVÉNEMENTS ANNULÉS OU REPORTÉS
Lorsqu'un événement est annulé ou reporté, Beat TV peut, à son entière et exclusive discrétion, soit vous offrir un échange ou un remboursement. Vous avez l'entière responsabilité de vérifier si un événement pour lequel vous avez acheté des billets par le biais de ce site Web est annulé ou reporté. Si un événement est annulé ou reporté, Beat TV vous informera par le biais de ce site Web des directives et procédures d'échange ou de remboursement.
De façon générale lorsqu'un événement est annulé la somme est créditée à la carte de crédit avec laquelle l'achat a été fait. Cependant, Beat TV se réserve le droit d'opter pour une autre forme de remboursement ou d'échange pour un événement en particulier.
Beat TV peut modifier ses politiques d'échange et/ou de remboursement, à tout moment, à son entière et exclusive discrétion. Tout changement au sujet de ces politiques se trouve sur le présent hyperlien.
ARRIVÉES TARDIVES
L'événement commence à l'heure fixée et les retardataires peuvent se joindre en tout temps durant l’évènement.
DROIT D'ANNULER UN BILLET, DE REFUSER L'ACCÈS ET D'EXPULSER
Beat TV se réserve le droit d'annuler tout billet ou commande de billets effectué par le biais de ce site Web et d'intenter des procédures judiciaires contre vous si vous êtes en défaut de respecter un ou l'autre des termes et conditions du présent Contrat ou de ce site Web.
Beat TV se réserve le droit d'exiger toute identification avec photo du détenteur de billet.
Advenant le cas où un spectateur est considéré incontrôlable, démontre un comportement inapproprié ou est en défaut de se conformer aux règlements, Beat TV se réserve le droit, sans aucun remboursement ni indemnité, de mettre fin au droit de telle personne d'assister à l'événement et de l'expulser sur le champ.
Les billets achetés via ce site Web sont des licences révocables et l'admission d'un titulaire de billet peut être refusée pour toute raison (ou aucune raison) sur remboursement de la valeur nominale du billet à la seule discrétion de Beat TV, ses employé(e)s, agents, officiers ou représentant(e)s. Les billets ne sont pas échangeables en espèces.
ENREGISTREMENT, TRANSMISSION ET PUBLICATION
Tous les caméras, magnétophones et appareils d'enregistrement vidéo (incluant lorsque incorporés dans des téléphones cellulaires ou autres appareils portables) ainsi que leur utilisation sont strictement interdits sur le site de l'événement.
Par les présentes, vous octroyez à Beat TV le droit d'utiliser votre image, votre ressemblance, vos actes et vos déclarations dans toute transmission, publication ou reproduction d'un événement de quelque façon ou circonstance que ce soit, sans autre permission ni indemnisation.
INTERDICTION DE REVENTE
Toute revente illégale de billets est strictement interdite. Beat TV se réserve le droit d'annuler toute licence octroyée en vertu des billets en relation avec toute vente de billets frauduleuse, sans remboursement ni autre indemnité.
PROMOTION INTERDITE SANS PERMISSION
Le billet ne peut être utilisé à toute fin publicitaire et/ou promotionnelle (incluant les concours et les loteries) ni vendu sans l'autorisation préalable écrite de Beat TV.
UTILISATION DE VOS RENSEIGNEMENTS PERSONNELS
En plus et sans limiter la généralité des dispositions prévues à notre Politique de confidentialité, en achetant un ou des billets via notre site Web, vous acceptez expressément que les renseignements personnels que vous nous fournissez soient utilisés par Beat TV ou les sociétés de son groupe et autres entités liées, ainsi que par ses commanditaires, fournisseurs, distributeurs, vendeurs, représentants et toutes personnes agissant pour et au nom de Beat TV, afin de vous ajouter à sa ou leur liste de diffusion, de vous proposer des offres et pour toutes autres fins promotionnelles ou de marketing de Beat TV. Nous vous rappelons que si vous désirez que nous cessions d'utiliser vos renseignements personnels, veuillez Communiquer avec nous.
LIMITATION DE RESPONSABILITÉ
Nonobstant toutes les mesures de sécurité mises en place sur le site, des blessures peuvent survenir durant l'événement. En acceptant les termes du présent contrat, vous assumez tous risques, obligations et responsabilités pour tout dommage de quelque nature que ce soit que vous pourriez subir, incluant sans s'y restreindre, tout dommage corporel et perte matérielle subis durant ou en relation avec l'événement. De plus, vous renoncez par les présentes à tout droit de réclamer des dommages ou d'intenter des procédures judiciaires, civiles, criminelles, administratives ou légales à l'encontre de Beat TV, des sociétés de son groupe et de ses autres entités liées ou de leurs administrateurs, dirigeants, gérants, employés, représentants et toutes autres personnes agissant pour et au nom de Beat TV, résultant de quelque cause que ce soit, peu importe qu'elle soit survenue avant, pendant ou après l'événement.
Dans certains cas, les lois applicables peuvent ne pas permettre la limitation de responsabilité tel que décrit ci-dessus faisant en sorte que cette limitation de responsabilité ne s'applique pas dans certains cas particuliers. Si une partie de cette limitation de responsabilité est trouvé invalide ou ne peut être applicable pour quelque raison que ce soit, dans ce cas la responsabilité totale de Beat TV des sociétés de son groupe et de ses autres entités liées ou de leurs administrateurs, dirigeants, gérants, employés, représentants et toutes autres personnes agissant pour et au nom de Beat TV, ne devra pas excéder cent dollars canadiens (100 $).
INDEMNISATION
Par les présentes, vous acceptez d'indemniser et de tenir Beat TV indemne, ainsi que les sociétés de son groupe et autres entités liées, leurs administrateurs, dirigeants, gérants, employés, représentants et toutes autres personnes agissant pour et au nom de Beat TV de tout dommage, réclamation, poursuite ou autre demande, incluant sans s'y restreindre, les coûts raisonnables relatifs à tout litige, tels que les frais juridiques découlant de ou en relation avec votre achat de billets.
LOIS APPLICABLES ET JURIDICTION EXCLUSIVE
Les parties acceptent, par les présentes, que ce Contrat soit interprété et régi par les lois du Ontario, ainsi que les lois du Canada applicables, sans tenir compte des principes de conflit des lois. De plus, les parties choisissent de soumettre tout différend ou toute procédure découlant de ou relatif au présent Contrat à la juridiction exclusive des tribunaux de la province de Ontario, dans le district judiciaire de Ottawa sans préjudice toutefois aux droits de Beat TV d'obtenir toute mesure conservatoire, telle l'injonction de toute cour de juridiction compétente.
CONDITIONS DU BILLET
Le texte suivant fait partie intégrante du Contrat :
IMPORTANT Aucun échange ou remboursement. En cas d'annulation de l'événement pour lequel aucune autre date n'a été choisie, le remboursement de ce billet pourra se faire selon les modalités indiquées par l'organisateur de l'événement et BEAT TV INC. Aucune remise des frais de service. Toute falsification ou revente de billets est interdite. Ce billet est invalide dès qu'il fait l'objet d'une plainte assermentée au service de police local à l'effet qu'il a été volé. Ce billet donne le droit à son détenteur d'assister à l'évènement et ne lui confère aucun autre droit. Ce billet ne peut être utilisé à des fins publicitaires, promotionnelles (incluant les concours et tirages) ou à toute autre fin commerciale sans le consentement préalable par écrit de (Beat TV) ou encore de l'artiste, selon le cas. Le détenteur de ce billet assume toutes les responsabilités quant aux risques et dangers pouvant découler de cet événement et renonce à toutes réclamations pour pertes et dommages résultant de quelque cause que ce soit, subis par le détenteur, que ce soit avant, pendant ou après l'événement. Le détenteur de ce billet renonce également à toutes réclamations pouvant découler de la captation et de la diffusion de son image de l’application de Beat TV. L'utilisation du billet est soumise aux règlements en vigueur sur la plateforme de l'événement. Vous devez vous conformer aux règles établies par l'organisateur de l'événement. La direction se réserve le droit de refuser l'accès à l'événement ou d'expulser toute personne dont le comportement sera jugé inadéquat avec ou sans remboursement du prix du billet. Il en est de même pour l'utilisation des appareils photos, magnétophones et caméscopes. Ce billet ou les droits qui s'y rattachent ou qui en découlent ne peuvent faire l'objet d'une cession, d'une vente ou d'un transfert, que ce soit dans un cadre commercial ou d'une campagne promotionnelle, avec ou sans contrepartie, sans avoir obtenu au préalable le consentement écrit de l'émetteur et de l'organisateur.
GÉNÉRAL
Dans le cas où une cour d'une juridiction admissible déclarerait une partie du Contrat invalide ou applicable, la balance du Contrat demeurera en vigueur.
Les titres dans ce Contrat ne sont indiqués que pour des fins de précision et ne font pas partie intégrante du Contrat.
Si vous avez lu le Contrat en anglais, les Parties acceptent que ce Contrat soit rédigé en français. Vous pouvez également faire demande du présent contrat en anglais.
